Welcome to SendStatus. These Terms of Service ("Terms") govern your access to and use of the SendStatus platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Service Description

SendStatus is a construction project management platform that allows users to create professional construction status reports by sending text messages, voice messages, and photos via WhatsApp to a designated company phone number. Our system processes these inputs using artificial intelligence and generates structured project updates. Users can then review, edit, and send finalized status reports through our web application.

Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You will receive a reminder email at least 30 days before your annual subscription renewal date.

You retain all ownership rights to your construction project updates, photos, voice recordings, and project data ("User Content"). By using the Service, you grant SendStatus a limited, non-exclusive license to process, store, and display your User Content solely for the purpose of providing the Service to you.

SendStatus and its licensors own all rights, title, and interest in and to the Service, including all software, AI/ML models, trademarks, logos, and proprietary technology.

Our Service uses Google Gemini artificial intelligence to process your inputs. While we strive for accuracy, AI-generated content may contain errors or inaccuracies.

You are solely responsible for reviewing, verifying, and approving all AI-generated content before sending it to clients or using it for any business purpose.

9. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We do not guarantee 100% uptime.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENDSTATUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Our Service integrates with: Google Cloud Platform, Firebase, Google Gemini AI, Google Maps, SendGrid/Twilio, WhatsApp/Meta, and Stripe. We are not responsible for their performance or privacy practices.

14. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of the State of Illinois. Any disputes shall be resolved exclusively in the courts located in Cook County, Illinois.

We reserve the right to terminate your account for violation of these Terms, non-payment, misuse of the Service, or fraudulent activity.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email and in-app notification.

17. Account Ownership & Data

The Account Owner is the individual who originally created the SendStatus account and agreed to these Terms of Service. The Account Owner has full control including:

The Account Owner may designate additional Company Administrators with the same capabilities.

Transferring Ownership: Log in as a Company Administrator, navigate to Settings → Team, select the team member to become new admin, and grant them Company Administrator privileges.

When Team Members Leave: Remove departing members through Team settings. Ensure another Administrator exists before removing an admin. Projects and reports remain with the company account.

Data Ownership: All data belongs to the company, not individual team members. This includes projects, reports, photos, and voice recordings.

Ownership Disputes: SendStatus does not mediate ownership disputes. We recognize the original account creator as the default owner and will comply with valid court orders.

18. Entire Agreement and Severability

These Terms, together with our Privacy Policy, Cancellation & Refund Policy, and Security Overview, constitute the entire agreement between you and SendStatus.
